The order aims to curb the practice of foreign nationals entering the United States on temporary visas for the primary purpose of giving birth on American soil to secure citizenship for their children.
The administration’s new policy asserts that United States citizenship is a “sacred bond” and a “great inheritance” that should not be treated as a “commodity to be acquired through calculated exploitation”. The order argues that birth tourism undermines the integrity of the nation’s immigration system and erodes public confidence in the enforcement of existing laws.
According to the text of the order, participants in these schemes often exploit nonimmigrant visa categories—intended for study, tourism, or temporary employment—to establish a permanent foothold in the country for their children and, eventually, themselves.
A primary target of the executive order is the thriving global industry of “birth tourism operators”. The White House claims these entities use deceptive advertisements to entice foreign nationals, promising access to public benefits and specialized facilities. Furthermore, the order alleges that these operators coach clients to misrepresent their travel intentions to consular and border officials to obtain entry authorizations.
The administration contends that these practices divert limited consular and enforcement resources away from legitimate applicants and impair the executive branch’s ability to protect national security.
The order delegates authority to the Secretary of State and the Secretary of Homeland Security to implement strict new measures. Under the new guidelines, officials are directed to:
- Prevent the entry or granting of visas to any alien suspected of traveling for the purpose of birth tourism.
- Revoke existing visas and travel authorizations for those attempting to engage in the practice.
- Permanently bar entry to individuals who enter or attempt to enter the U.S. for birth tourism.
- Take appropriate action against entities and organizations responsible for facilitating birth tourism, both within and outside the United States.
The order defines “birth tourism” as the entry of any foreign national via a nonimmigrant visa for the purpose of giving birth on American soil, or any effort to facilitate such an entry.
While the policy sets a hard line, it does provide for exemptions. The Secretary of State or the Secretary of Homeland Security may grant waivers on humanitarian grounds or when a foreign national’s entry is deemed to be in the national interest.
