James and McFee freed of murder

Martin Jah-son James along with Ricardo McFee both from the community of Villa were this afternoon freed on charges of murder on Mazarie Lee and attempted murder on Mozart Primus and his common-law wife Shelly-ann Durham at Fair Hall Housing Scheme on October 7th, 2016.

The accused freedom came after a no case submission was put forward by their Defense Counsel Grant Connel and Israel Bruce at the conclusion of the Prosecution’s case which was put forward by Senior Prosecutor Adolphus Delpesche.

During the Preliminary Inquiry Delpesche made an application to have an adjournment to facilitate the evidence of a key witness who expressed concern in coming to Court to give evidence and that he wish to have such evidence given via video link.

This was however over-ruled by Chief Magistrate Rechanne Browne after the Defense Counsels objected.

In their submission the lawyers submitted that the evidence adduce by the Prosecution did not substantiate the charges and that the evidence was riddled with inconsistencies. This was agreed by the Magistrate.
