A Judge Cannot Order A Bye Election – Sir James On Boom Fm
Former Prime Minister Sir James Mitchell says he has been asked a lot of questions about the recent hearing of election petitions, he says he knows what it is like to change a government but he is not into the business of prophecy.
“ For heaven’s sake, no matter how it goes, lets us say NDP wins, I want to people to get the notion out of their head that NDP will form a government the next day”.
“ Pay attention to the constitution of SVG, and the Powers of the office of the Prime Minister, there is no NDP government tomorrow if the NDP wins, get that clear”.
Sir James says he will give three scenarios
1 NDP wins
2 NDP Lose.
3 NDP Goes To An Appeal
It’s not just about Legal or constitutional matters, its about political choice to the events.
Everyone from the evidence presented would accept there were irregularities.
“ Ralph nor the ULP can’t say there were no irregularities”.
Stalkly John is the one who exposed the irregularities in the SVG electoral process and I want to thank him, said Sir James
So where do we go from here, asked Sir James?
James said if NDP wins the Judge cannot order a bye-election, he can only give judgement on the petition before him, concerning irregularities.
“ The next question is how will the Judge interpret these irregularities, we have gone through several judges in this exercise, and we have to accept the principles of justice in our democracy”.
It is the decision of the Judge which will determine if NDP wins or ULP Lose.
Sir James says if there has to be a bye-election the ball is the court of one man Ralph E Gonsalves.
“ I don’t love Ralph, but I know the constitution, and it would be up to him to call any bye-elections, not NDP”.
