Donald Soleyn a former member of the Local Constabulary now a Bailiff at the Magistrate’s Court here counted his lucky stars and walked out of the Kingstown Magistrate Court a free man after he was told by Senior Magistrate Rickie Burnett that the three cases of corruption, misappropriation and deception were dismissed for want of Prosecution.
The charges reportedly stemmed from transaction between Solelyn and Wayne Peters from Bequia when he was said to have collected $200.00 but failed to pay same into the Magistrate’s office between December 31st, 2015 and January 1st, 2017.
A trial which began a few months ago was adjourned after presentation from a female clerk at the Magistrate’s office was schedule to be continued on October 29th, 2018 to facilitate the appearance of Peters who failed to appear.
It was during such time Senior Prosecutor Adolphus Delpesche summoned female Police Constable Donna Kennedy to the witness box who is attached to the Process Department of the Local Constabulary.
Kennedy informed the Court that a summon was sent to the Bequia Police Station to be served upon Peters for his attendance, she also stated that she personally contacted him via phone and he had promised to appear to give evidence but on subsequent occasions she was unable to contact him again.
